Advertising Solutions Tentative Agreement Dec 17, 2010
This is to advise you the Tentative Agreement reached on November 19, 2010 with AT&T Advertising Solutions (dba) AT&T Yellow Pages was overwhelmingly ratified, by a majority vote on December 16, 2010.
The vote was 76.6% yes in support of ratification and 23.4% no against ratification.
The next step in the process is to now proof all of the agreed to items and make any corrections necessary, at which time the Company will have the contracts printed, and then the contracts will be distributed to the membership.
This process will take an extended period of time so please be patient.

Advertising Solutions Tentative Agreement Nov 19, 2010
Bargaining is often a long and difficult process. Your Bargaining committee along with the Company’s Committee would like to jointly express their appreciation towards the process that has culminated in a third Tentative Agreement.
The backdrop for bargaining included the worst economy in fifty years. The print business has continued to decline. Multiple surpluses may continue. These factors have made bargaining a long and difficult process.
The Bargaining Committee appreciates all of your dedication and support. The Committee unanimously recommends ratification.
Listed below are the details of the new tentative agreement:
Treat December 27, 28, 29, and 30, 2010 as “Special Christmas Days”, paid at basic salary, for all employees.
Non-commissioned wages are as follows:
2.75% effective December 5, 2009
2.5% effective May 1, 2011
2.5% effective June 3, 2012
2.5% effective July 7, 2013
Note: Retro pay for non-commissioned employees will provide a year's worth of back pay.
Non-Commissioned employees, will receive a Retention Bonus (in lieu of a ratification bonus) as follows:
Any employee who is on the payroll as of December 2010 will receive $500.00.
Any employee who is on the payroll as of December 2011 will receive $ 300.00.
Any employee who is on the payroll as of December 2012 will receive $ 200.00.
Any employee who is on the payroll as of December 2013 will receive $ 200.00.
Non-Commission Employees Pensions
Increases to the pension bands as follows:
2% effective June 1, 2011
2% effective June 1, 2012
2% effective June 1, 2013

Account Representatives
Account Reps at top pay under the old contract $326/week, $17,017/year
Account Reps at top as of December 5, 2010 new contract $385/week
Account Reps at top as of June 5, 2011, new contract $578/week, $30,171/year, for the life of the agreement.
Sales Representatives
Sales Reps at top pay under old contract $269/week, $14,041/year
Sales Reps at top pay as of December 5, 2010 under new contract $308/week
Sales Reps at top pay as of June 5, 2011 under new contract $443/week, $23,124/year for the life of the agreement.
Senior Account Representatives
Senior Account Reps pay under old contract $670.50/week, $35,000/year
Senior Account Reps at top pay as of December 5, 2010 under new contract $673.50/week
Senior Account Reps at top pay as of June 5, 2011 under new contract $1020/week, $53,244/year for the life of the agreement.
Cyber Representatives
Cyber Reps pay under old contract $600/week
Cyber Reps pay under new contract as of December 5, 2010, $600/week
Cyber Reps pay under new contract as of June 5, 2011, $638.50/week, $33,329/year.
All employees who are in wage progression will be placed at the appropriate step in the progression schedule and will receive the appropriate increases on December 5, 2010, and June 5, 2011. (A complete copy of the wage schedules will be provided to each local as soon as possible).
Commission Plan
There have been changes made in the gates and rates based on the new guaranteed monies put into the wage base. All appropriate changes have been made relating to minimum increase of 3%, new hire gate adjustment, rollover of new install and non-advertiser.
Note: *Average pay for Commissioned employees will provide a year's worth of back pay. All days paid at average will be recalculated to include IYP earnings beginning December 5, 2009.
* Expense reimbursements will be recalculated beginning December 5, 2009.
Article XVII – Force Adjustment
In sales titles prior to going in order of inverse seniority, the Company may offer termination pay as calculated under Article XVII on a voluntary basis to any commissioned employee in the impacted work group that is on a Performance Improvement Plan (PIP) step or in the fourth quartile based on net increased percentage.
Article XVII – Section 6
6 (a) 1: any employee who was in the bottom quartile when laid off, will return as a probationary employee for one (1) year.
6 (b) 2: any employee who was in the bottom quartile when laid off, will return as a probationary employee for one (1) year.
Article XVIII - Employment Terminations
1(c): New language, Dismissed except for reasons of misconduct, after having 10 or more years of net credited service
Article XII – Nondiscrimination
Added: sexual orientation to the existing language.
Transition Severance Payment replaced by Surplus Severance Incentives to tenured commissioned sales representatives:
When the Company declares surpluses in the sales channels, in the fourth quarters of 2011, and 2012, commissioned sales representatives who are service pension eligible and who choose to exit the Company, will be eligible to receive an enhanced severance payment, equal to 120% of the severance amount they are entitled to.
FMLA
New language which allows for Union Representatives on Union Business now, will have that time considered as time-worked for the purposes of FMLA eligibility.
Benefit Agreements
Current employees shall be defined as bargained employees hired/rehired on or before May 31, 2011. New hires shall be defined as bargained employees hired/rehired or transferred into Yellow Pages bargained titles after May 31, 2011. Current employees and new hires medical contributions annual deductibles and annual out of pocket maximums will not start until June 1, 2011.

The Union and the Company met last Thursday November 11, 2010 and presented the Company with a comprehensive proposal. The Union continues to wait to the Company’s response.
Advertising Solutions Bargaining Report #12 Nov 10, 2010
The Union and the Company met on Tuesday, and lengthy discussions ensued over the future of the business and the industry as a whole. Current trends are expected to continue, loss of print revenue, surplusing, and growth of the IYP business.
Health care cost the have gone down on average over the last two years and the Company’s complaint that they have not been able to shift more health care costs on to the workers. The Union pointed that the Company is accelerating their pursuit into the 34 billion dollar health care market.
AT&T has generated over 4 billion dollars in the health care market. The Company has the ability to harness innovative technology to help improve patient care and further reduce medical costs nationwide.
The Union can only ask, why are you hitting our members so hard on health care. The Union reminded the Company that the Yellow Pages business has provided 10.8 billion dollars in profit since the last time we have negotiated our 2004 Agreement. AT&T has also sold parts of their business (i.e.) L.M. Berry and who knows what the future holds. The Union has provided another major proposal to the Company.

AT&T Advertising Solutions Bargaining Report #11 Nov 08, 2010
The Union and the Company met on Saturday, November 6th and Sunday, November 7th. The parties had long discussions on what has happened in the last year. The worst economy in fifty years, high unemployment and other local contracts that have been voted down twice. The Company is not interested in increasing the cost of the package. The Company has not been able to shift health care costs onto the workers. The Company refuses to move on wages, they eliminated the $500 ratification bonus, they cut the pensions increases for non-sales, they removed termination pay for performance, they eliminated the TSO. The Company has reduced wages to offset healthcare cost, and now Christmas week is in jeopardy. The Company has made a second proposal to conclude this round of Bargaining.

AT&T Advertising Solutions Bargaining Report #10 Nov 05, 2010
The Union and the Company met today to discuss the following issues:
1. Surplus by quartile
2. Eliminating termination pay on performance
3. Removing the TSO
4. Rolling back base wages
5. No base wage increases for sales, no commission adjustments
6. Health Care premiums, deductibles, and out-of pocket
7. Elimination of the Ratification Bonus
8. Pensions
9. Safety net for sales
10. Assignment issues
The Union then presented the Company a proposal on most of these
issues in an effort to move negotiations forward.
The Union and the Company plan to work throughout the weekend.

The Union and the Company met on Thursday November 4, 2010 and had in depth discussions relating to termination pay, surplusing by Quartile and the Transition Severance Offer.

AT&T Advertising Solutions Bargaining Report #8 Nov 04, 2010
The Union and the Company met on Saturday, Sunday, and Monday for in depth discussions on the retrogressive proposal which the Company gave the Union last Friday.
The Union made the Company aware of the need to remove all retrogression from the table so the parties can begin serious discussions which would allow us to reach a tentative agreement.
The Union is working to prepare another comprehensive proposal which will be presented to the Company, and we will continue to work to get the best agreement possible.
AT&T Advertising Solutions Bargaining Report #7 Oct 29, 2010
On Thursday October 28, 2010 the Union and the Company met in the afternoon with the Company responding to the Union’s comprehensive package. The Company denied all of the Union’s proposals except one which they said they are considering.
The Company then presented their counter proposal to the Union which included the following ROLL BACKS:
Noncommissioned base wage increase was rolled back first year to July 4, 2010
Noncommissioned base wage increase reduced and rolled back second year to July 3, 2011 and
reduced
Non commissioned base wage increase reduced and rolled back third year to July 8, 2012 and reduced.
Noncommissioned base wage increase reduced and rolled back forth year to July 7, 2013 and reduced.
$500 signing bonus was rolled back to zero.
HRA offered by the Union to help defray the cost of health care cost were rolled back to zero.
Base wage increases for the Sales Reps, Account Reps, Senior Account Reps and Cyber Reps were rolled back to July 4, 2010, July 3, 2011 July 8, 2012 and July 7, 2013.
Rollbacks in force adjustment, by surplusing by performance for sales.
Rollbacks on termination pay if dismissed, except for reasons of misconduct, after having three or more years of net credited service.
The Company rolled back the pension increase for non-sales from 2% to zero for 2010.
The Company rolled back medical coverage contributions to June 1, 2011 for new hires and current employees.
The Company rolled back the annual deductibles to June 1, 2011 for individual and family.
The Company rolled back the annual out of pocket maximums to June 1, 2011.
When you move to the new plan in the middle of the year you may pay 3 separate sets of deductibles: medical, prescription, and dental.
On October 3rd when this round of bargaining began the Company provided your Bargaining Committee with their modeling numbers for 2009 publication cycle. Much to the Company’s surprise their proposed rates & gates compensation plan overall paid all commissioned sales titles substantially less than the current labor agreement.
The Company’s new proposal does nothing to address the previous proposed rates and gates.
Their new proposal now includes a provision to surplus commission representatives, by performance, rather than seniority. Representative’s surplussed in this fashion no longer qualify for termination pay.
The Company’s proposal no longer includes the Transition Severance Offer
(TSO).
If ratified, the Company has agreed to consider Union proposals outside of the plan to improve future earnings opportunities for the impacted commission-based sales employees at the end of each publishing cycle in the event there is a material change in the channel average earnings under the new plan. (i.e. percent reduction is greater that the percent reduction in Company’s revenue production). Based on AT&T’s quarterly report (October 21st) AT&T Advertising Solutions segment operating revenue for the 3rd quarter ending September 30, 2010 fell 17.3% as compared to the three months ending September 30, 2009.

Today the Union presented the Company with a comprehensive proposal in an attempt to reach a tentative agreement. The Company will be reviewing the proposal over the weekend and will respond to the Union on Monday. Please keep up the Mobilization.

The Union and the Company met on Friday and Saturday. We discussed an alternative method on assignment of accounts. We had additional discussions to clarify the proposed commission plan. The Company and the Union met yesterday; we received information on document requests that we had made previously. The Company answered some of the previous questions that we had. The Union and the Company spent today caucusing and preparing for meeting tomorrow. The Union and the Company are scheduled to meet tomorrow, Friday, to discuss additional issues related to the data requested by the Union.

The Union and the Company met on both Thursday and Friday and continued discussions on multiple facets of the compensation plan. The Union made the Company aware of the concerns of the Sales Reps and how the proposed plan will affect their compensation.

The parties discussed the state of business, and the Company provided the Model Sheets for 2009.
The Union then caucused to review the information provided. The Union is in the process of preparing additional questions and data requests.
D6 AT&T Advertising Solutions Ratification Vote May 28, 2010
This is to advise all AT&T Advertising Solutions members that the Tentative Agreement reached on April 28, 2010 was not ratified by a majority vote of the members on May 27, 2010.
The Tentative Agreement was voted down by a 51.5% margin, which means 48.5% wanted the new agreement but 51.5% did not. As more information becomes available it will be posted on this web site.
AT&T Advertising Solutions Bargaining Report #42 April 29, 2010
BARGAINING HIGHLIGHTS:
Listed below is a brief summary of the 17 modifications which have been agreed to in the new Tentative Agreement reached on April 28, 2010.
Wages – Base wages will be retroactive back to December 5, 2009, new wage increase will go into effect March 6, 2011, March 4, 2012 and March 3, 2013, respectfully.
Pensions for Commissioned Representatives – New calculation is the highest 3 years of the last 5 years will take effect on January 1, 2011.
Vacation Accrual – Any member who passes away will have all of their vacation paid to their estate.
Special Christmas Days – The Company will designate I EWP or 1 vacation day provided the employee requests the change to vacation day prior to the applicable date. Vacation days can not carry over into the next year.
Commissions for Cyber Representatives – Amended commissions for Cyber Representatives.
Commission Advance Recovery Process – New language, “If a query is not resolved before “query boost” due to the responsibility of the Representative, for commission purposes, the Representative will be held responsible for reporting base and objective, and get no credit for the retired revenue. The result will be a commission adjustment.”
Transition Severance Offers (TSO) for tenured commission sales representatives, will be offered for the fourth quarters of 2010, 2011, and 2012.
Reemployment – Allows an employee who has been surplussed will be allowed to test for other positions within the same wage classification in the metropolitan area affected by the layoffs if additional employees are needed, before the Company hires from the street.
Achievement Bonuses – Letter regarding Achievement Bonus and Incentives for non sales employees.
New Committees created for Sales Representatives and Cyber Representatives.
Retro activity back to December 5, 2009 on all grievances and arbitrations.
Enhanced Termination pay regarding the treatment of surplussed employees named in the March 17, 2010, and April 9, 2010 Force Adjustment Announcements.
Commission Income Protection Program (CIPP) for Account Representatives, Senior Account Representatives and Sales Representatives.
Letter regarding non-pay chargebacks on the sale of new products reported in the introductory first year of those new products.
Memorandum of Understanding regarding Short Notice Excused Work Day Trial.
Letter regarding “early downed” accounts assigned to the Cyber channel.
Letter to address Cyber Representative force churn and sales developmental plans.
The Tentative Agreement must be ratified by May 28, 2010.

AT&T Advertising Solutions Bargaining Report #39 April 16, 2010
The Union and the Company have met several times and have discussed the new commission plan at length. Major discussions revolved around the TSO, the CIPP plan and a developmental plan. Wages and surplus language were also part of the discussions.
On April 14, 2010 the Union presented a comprehensive package to the Company that addresses these issues in hopes of reaching a new tentative agreement.
The Union is waiting for the Company's response. As more information becomes available it will be posted on the web site.

AT&T Advertising Solutions Bargaining Report #38 April 14, 2010
The Union and the Company met on Tuesday, April 13, 2010, the Union asked more questions about the Company's compensation plan and other issues. The Union and the Company will meet on Wednesday, April 14, 2010 at which time the Company will provide the answers to the Union's questions.
The Union st trying to address issues in the Company's revised Final Offer given to the Union on March 27, 2010, and as of this time the Union has not responded to that offer. The offer failed to address all of the Union's concerns.
The Union committee is working on a package that they will present to the Company, which will hopefully help us reach another tentative agreement, which can be ratified by the membership.
AT&T Advertising Solutions Bargaining Report #37 March 30, 2010
On Friday March 26, 2010 the Union worked on getting additional bargaining proposals ready to give to the Company. The Union and the Company met mid afternoon, provided the Union's proposals, and answered any questions that the Company had relating to the proposals.
The Union met with the Company again on Saturday, March 27, 2010 and the Company responded to the Union's proposals and gave the committee a revised Final Proposal in an attempt to reach another Tentative Agreement.
The Union will be evaluating the Company's proposals as soon as possible, and then make a decision as to when we will meet with the Company again.
AT&T Advertising Solutions Bargaining Report #36 March 25, 2010
The Union and the Company met yesterday March 24, 2010 at which time the Union presented several proposals to the Company in an attempt to start moving closer to another Tentative Agreement.
The Union spent time asking questions in an attempt to get a clear understanding on specific issues, which the Union believes are critical to reaching another Tentative Agreement. The Elected Committee continues to work to write proposals, which once presented to the Company, would help us reach an agreement.
The Company has rejected most of the proposals, which the Elected Bargaining Committee has presented to them.
As more information becomes available another bargaining report will be posted.
AT&T Advertising Solutions Bargaining Report #35 March 2, 2010
The Union and the Company met this morning, March 2, 2010 at which time the Company responded to the Union Proposals. The Company rejected most of the proposals presented by the Elected Committee. The Elected Committee is now working on amended proposals, which will be presented to the Company as soon as they are completed.

The Union and the Company met on Sunday, February 28, 2009. The Company requested clarification on the Union's proposals, and the Union provided clarification and responded to additional questions asked by the Company.

AT&T Advertising Solutions Bargaining Report #31 February 18, 2010
The elected Bargaining Committee members have completed an initial draft proposal. Additional work still must be done to finalize the proposal before it can be presented to the Company. The elected committee members will continue to work this week to finalize the proposal insuring that all Union demands that are issues are included in the proposal. All of the Locals should continue to mobilize members to support the Bargaining Committee and the new proposals that will move us closer to a Tentative Agreement.
AT&T Advertising Solutions Bargaining Report #30 February 16, 2010
This is to advise that the elected members of the CWA Bargaining Committee were requested by CWA District 6 to develop a bargaining proposal to present to the Company that they will recommend for ratification by the membership. This proposal developed by the elected committee members will be presented and explained by the elected committee. No agreements will be reached without the input, consultation, and agreement of the elected bargaining committee. The committee has been asked to develop the proposal and present it to the Bargaining Chair no later than Wednesday February 17, 2010. It will then be presented to the Company as quickly as possible.
The Locals should mobilize members to support the Bargaining Committee and the NEW proposal that will move us closer to a tentative agreement.

The AT&T Advertising Solutions Tentative Agreement has been rejected by a 65% vote authorizing the President of the Union to set a strike date.

DURATION
· Four-year Contract expires December 6, 2013
EARLY RATIFICATION AWARD
· The Company will grant four (4) Special Christmas Days paid at salary for time between Christmas and New Year 2009 as a ratification bonus
· $500 ratification bonus on or before the second payday after ratification
· To receive the $500 Ratification Bonus, agreement must be ratified by January 28, 2010
· Letter explaining that should the Tentative Agreement not ratify, the $500 ratification bonus will not be paid
WAGES - NONCOMMISSION EMPLOYEES
· Average general wage increases for non-commission employees compounded to 11.75%. Percentage wage increases will be applied exponentially, with no change to the start rate:
- Base Wage Increase of 2.75% effective December 5, 2009
- Base Wage Increase of 3% effective February 6, 2011

TEAM PERFORMANCE AWARD PLAN (TPA)
· Renewed the Team Performance Award Plan (TPA) for non-commission employees, which will be received in 2011, 2012 and 2013 for performance years 2010, 2011 and 2012, respectively. A minimum amount guarantee is included.
COMMISSION EMPLOYEES
· Incorporated Senior Account Representatives and Cyber Representatives into Article XXVI
· Substantial increase in base wages for Account Representatives, Sales Representatives, Senior Account Representatives and Cyber Representatives. Based salaries increased as follows:

· Mileage for authorized use of personal vehicle will increase to .42 cents per odometer mile effective 01-01-2010, effective 01-01-2011 increased per odometer mile .43 cents, effective 01-01-2012 increased per odometer mile to .44 cents, effective 01-01-2013 increased per odometer mile .45 cents, not to exceed allowable IRS maximum.
· Long Term Parking allowance increased to a maximum of $9/day to $12/day

Prescription Drug Plan
· There are no deductibles in the Prescription Drug Plan for the years 2011, 2012, 2013
· Specialty pharmacy program.
· Mandatory use of generic drugs - If generic exists and brand selected, then you pay generic co-pay plus the difference between brand and generic. Documentation by doctor can confirm that you must use brand.
· Maintenance prescriptions are required to be filled through the mail order after second refill at a retail location, or picked up directly at a CVS retail pharmacy.
· The appeals process will stay in place to pay the lower co-pay rate when a non-formulary drug is medically necessary.
· An arrangement has been made between the Company and CVS that will permit pick up at the CVS retail locations of 90 day prescriptions for maintenance drugs while receiving the mail-order rate. This applies even after the prescription has been filled the allowable number of times at a retail pharmacy. This benefit will be available as soon as administratively possible.

The Union and The Company met on Saturday December 5, 2009, and the Union presented a counter commission plan proposal Saturday afternoon, which covered all aspects of the existing commission plan, also the Union proposed keeping all current language as is and included wage increases to base pay. The Company reviewed the Union's proposal and rejected that proposal Saturday afternoon.
The Company then presented the Union with their second comprehensive package which the Bargaining Team spent the rest of the weekend reviewing. The Company proposed no job upgrades, no base wage increase in the first year, a cut in termination pay, vacation accrual, and other retrogression.
The Company's rejection of the Union's proposal to keep the current commission plan, and their insistence on a completely new plan, which was provided to the Union just six days before the contract expired. This has slowed down any progress which could have been made, and caused the Union to make additional data requests to enable the Union's committee to better understand the effects of the Company proposed plan.

The Union and the Company met today, and the Union rejected the Company's first package as totally inadequate. The Committee does not believe that we will reach an agreement before the deadline tonight. Having said that, each Local should notify their members that we will be working without a contract and everyone should report to work as usual on any scheduled tour. The Union and the Company will continue to bargain throughout the weekend to try to reach an agreement, which the members can support.

The Union and the Company met late last night and the Company provided the Union with their first comprehensive package. The bargaining team spent last night and all of today reviewing all aspects of the proposal. We are finding inadequacies in all areas of their proposal.

The Union and the Company met again today December 1, 2009, at which time there were lengthy discussions about the Sales Compensation Plans for all commissioned reps.
The Union presented amended proposals on multiple issues, and had lengthy discussions about state of the business today, and what the future holds. The Company has consistently pressed the need to have flexibility in implementing changes without contractual constraint. This would affect assignments of all accounts, channel allocation, assignment levels, etc.
The Union and the company plan to meet again tomorrow and continue to reach an agreement which meet the needs of our members and will be completed by the expiration date.

The Union and the Company met on Sunday, November 29, 2009 and discussed every bargaining proposal, which has been placed on the table. The Company presented their proposal relating to Article 26, which places all commissioned titles in the same article. Extensive discussions were held and the Union asked many questions for clarification purposes to understand the Company's proposal. The Company has placed retrogressive proposals on the table, which would affect our members for the life of the agreement.
The Union and the Company agreed to meet again tomorrow with the Company responding to other Union proposals.
We have finally begun to really bargain, after five weeks. It appears very serious negotiations are beginning to take place.

The Union and the Company met on Friday November 27, 2009 and the Company presented two proposals, one relating to drastically reducing Termination Pay and the other proposal, related to changing from the earned vacation that we have today, to accrued vacation. The Company stated that this would be an accounting saving to the Company. The Company provided no information on how much money this would save the Company.
The Company then responded to the Union's proposals relating to the Commissioned work force. The Company rejected many of the sales proposals.
The Union and the Company met again on November 28, 2009 and the Company made a presentation relating to the Company's new-composed commission plan. The bargaining committee spent the afternoon going over the Company's presentation.
The Union will meet with the Company on Sunday November 29, 2009 and will ask questions about the proposed plan and get clarifications on the issues.
As each of you are aware, we only have one week until the expiration date of this agreement. The Bargaining Committee needs your support, which can be done by taking part in all mobilization activities within your Local.

The Union was finally able to obtain the information which was requested in its' data request on Friday November 13, 2009. The Union committee worked over the weekend and again on Monday and Tuesday in an attempt to finalize their proposals on the Sales items.
The Union and the Company met on Wednesday November 25, 2009 and presented the Union's proposals on Sales Reps compensation and commission plans. We also presented language which address many of the other concerns given to us by the Sales Reps. During the presentations the Company asked clarifying questions, and the parties agreed to meet on Friday November 27, 2009 and make every attempt to meet as often as possible, and as long as possible, in order to reach a fair agreement by the contract expiration date.

The Union and the Company met in full committee on Friday, November 20, 2009, and discussed the following issues:
1)Car and mileage expenses 2)Contractors 3)New products and services
The Company's presentation on the car allowance mirrored their presentation from 2001 bargaining and showed little change since that time.
Conversations were held on the future of the business and the Company made it very clear that print revenue is down and that internet revenue is up and that is the future of the business. The Company advised the Union that they need flexibility to run the business, but what they haven't shown the Union is how they plan to run the business in the future.
The Company indicated that their proposal on the commission plan would show \ldblquote a dollar is a dollar\rdblquote , thought process. As of this report the committee has no idea what this would mean to the Reps. More to come on this one in the future.
As of Friday the Company has responded to only a couple of the Union's proposals, and no progress has been made in this round of bargaining. The Union continues to tell the Company that they need to get down to business and start bargaining in a very serious manner, because we only have two weeks until the expiration of this agreement.
As the committee has stated before, this is your contract, this is your future.

The Union and the Company met on November 12, 2009 with the Union making presentations on all job upgrade proposals. The Advisors elected to the Bargaining Committee made the following proposals:

The Company still refuses to provide the Union with a copy of certain information contained in the Union's data request. This in itself has slowed the bargaining process. The Union has filed charges with the National Labor Relations Board on this issue.
The next bargaining report will be placed on the website as soon as the committee has information to provide to the members.

Today, November 10, 2009 the Union spent hours going over information, which was requested in the data request. The Union has to go to the Company's location to view the information because, the Company refuses to provide the information without a signed Non-Disclosure Agreement. In the afternoon the Union and the Company met and the Union asked questions about the information and how the Company showed the requested information.
Tomorrow, the Union and the Company will meet and the Union will do a presentation on the CWANet, relating to the Training/Retraining proposal which the Union has given the Company.
No progress was made today, as the Company has not responded to any of the Union's proposals. If the Company continues to drag out this bargaining the Committee's fear is that we will not have an agreement when the contract expiration date arrives.

This report is for November 9, 2009 at which time the Union has not met with the Company for several days. The Company continues to refuse to give the Union information requested on its data request, without signing a Non-Disclosure Agreement.
The information, which the Company is refusing to give the Union, is critical as it relates to the Union being able to pass specific proposals to the Company, relating to Sales issues.
The Company has only responded to only a very small number of the Union's proposals and continues to cause delays in this round of bargaining. The Company in its opening remarks stated very clearly that they had every intention of bargaining a fair and just contract, and they wanted to have a tentative agreement by the contract expiration date. At this rate that will not happen unless, the Company decides to come to the table on a daily basis and bargain with this Union.

CWA/AT&T Advertising Solutions Bargaining Report #4 November 3, 2009
The Union has spent the last several days in caucus, reviewing and refining the bargaining proposals, gathering supporting information, and preparing for the next round of discussions with the Company.
The Union and the Company are scheduled to meet today, November 4, 2009 at which time the Company will respond to the Union's initial proposals. All though it appears bargaining is moving slowly, the committee is working many hours to make sure that all items are covered properly and that the committee is doing the best it can for the membership.

The Union and the Company met yesterday, October 26, 2009 for the opening of 2009 negotiations. During the meeting both parties showed interest in reaching an agreement that the Union, Company, and members would support.
The Union presented all of their proposals to the Company after which, discussions began on those proposals. The parties agreed to recess and will plan to hold joint meetings on Wednesday, October 28, 2009, to further discuss proposals. The Union will provide the Company with additional information on the proposals.
Remember this is your contract; mobilization is the key to our success, and your future.
Wear Red on Thursday and Black on Friday.
